Welcome to the HERITAGE Beta Programme

Thank you for supporting the development of HERITAGE. Your Beta Pre-Order helps us complete production, testing, and deployment of the platform while giving your family early access to our first release.

These Terms & Conditions explain how the Beta Pre-Order works, your rights as a customer, and our commitments to you. We encourage you to read them carefully before completing your purchase.

Why is there a funding threshold?

HERITAGE is currently in active development. To ensure we can deliver a secure, high-quality Beta experience, we require a minimum of €10,000 in pre-orders before production begins.

If this minimum is not reached, every eligible pre-order will be refunded in accordance with these Terms.

HERITAGE is not a crowdfunding campaign. Your purchase is a commercial Beta Pre-Order for early access to the platform. If the minimum deployment threshold is not achieved, eligible payments will be refunded.

1. Overview of Heritage

Heritage is a culturally grounded, game-based digital language learning platform designed for diaspora children.

Initial Beta release focuses on Yoruba.
Future expansions may include Swahili and additional African heritage languages, depending on development and business feasibility.
Heritage combines:
- Interactive digital gameplay
- Structured curriculum progression
- Optional teacher-guided virtual sessions
- Cultural storytelling elements

Participation in the Beta phase is for a pre-release, non-final product.

2. Nature of Beta Pre-Order – Founding Access

A Beta Pre-Order constitutes Founding Access to the Heritage platform during its pre-release phase.

Founding Access is:

An advance purchase of limited early access to the Heritage Beta platform
A structured early participation opportunity prior to public launch
An advance purchase that helps finance the continued development, testing, and deployment of the HERITAGE Beta platform.
Conditional upon minimum funding thresholds being achieved
Limited in availability and time

Founding Access is not a discounted sale, promotional markdown, or temporary price reduction.
It represents a limited early participation category offered prior to full public release.

A Beta Pre-Order does not constitute:

Purchase of a finished or fully commercialized product
A donation
An investment in Ray Global Digital Oy
Equity, shares, or ownership rights
Profit participation or revenue share rights
Guaranteed feature inclusion, expansion, or future language development

Participants acknowledge that Heritage is in development and that feature sets, curriculum scope, delivery format, and deployment structure may evolve during the Beta phase.

Founding Access grants a limited, non-transferable right to use the Beta platform in accordance with these Terms.

3. Minimum Funding Requirement

Minimum Commercial Deployment Threshold: €10,000 gross - The Heritage Beta will proceed only if Ray Global Digital Oy reaches the minimum commercial deployment threshold of €10,000 (gross pre-order revenue).
If not reached:
- Beta deployment will not proceed
- Eligible pre-order payments will be refunded
Ray Global Digital Oy may extend or adjust the funding window at its discretion

4. Deployment Timeline

Ray Global Digital Oy currently anticipates deployment approximately six (6) months after the minimum deployment threshold has been achieved.
Timeline is estimated, not guaranteed, and may be delayed due to:
- Technical development
- App Store approval cycles
- Security, compliance, or educational refinements
- Force majeure or third-party delay - Ray Global Digital Oy shall not be liable for delays or failure to perform obligations resulting from events beyond its reasonable control, including but not limited to: natural disasters, war, civil unrest, pandemics, internet outages, cloud service failures, cyber incidents, regulatory changes, third-party platform restrictions, acts of governmental authorities
No refund or penalty arises solely from timeline adjustments unless Ray Global Digital Oy formally cancels the Beta release

5. Refund Policy

Refunds are available only if:

Minimum funding goal is not met
Ray Global Digital Oy cancels the Beta release
Refunds will normally be processed within 30 calendar days after cancellation of the Beta deployment.

Refunds:

Processed within a commercially reasonable timeframe
Returned to original payment method where possible
May exclude non-recoverable processing fees
No refunds after Beta access is granted and activated

6. Beta Product Disclaimer

Participants acknowledge:

Beta is incomplete; features may change or be removed
Curriculum rollout is phased
Technical bugs may occur
Features, gameplay, curriculum, artwork, user interface, educational content, pricing, and technical functionality may change at any time during Beta development.

Ray Global Digital Oy makes no warranty that the platform will be uninterrupted, error-free, or complete.

7. Access Tiers'

All tiers are one-time payments unless otherwise stated. Prices are VAT-inclusive. Access is non-transferable unless explicitly stated.

Limited to 20 Families
Covers ages 3–12 structured curriculum cycle (~10 years)
Beta access, curriculum progression, founding family recognition
Optional Virtual Class Integration Model (€30 per quarter, 20 children limit)
Lifetime refers strictly to the structured learning cycle
Does not extend indefinitely or guarantee future language expansion
After curriculum completion, access may conclude or transition to standard subscription pricing

8. Virtual Learning Pilot (Optional Add-On)

Quarterly Fee: €30 per child per quarter
Format: Private 1:1 or small group
May adjust during Beta
Ray Global Digital Oy may change instructors, schedules, teaching formats, or delivery methods where reasonably necessary.
Missed sessions due to participant absence are non-refundable unless legally required
Participation is not guaranteed beyond Beta pilot

9. VAT Treatment

Prices include Finnish VAT (25.5%) where applicable
VAT is applied in accordance with Finnish law and EU VAT directives
International participants may be charged according to their local VAT requirements

10. Consumer Right of Withdrawal (EU 14-Day Digital Content Waiver)

EU consumers normally have a 14-day withdrawal period
This does not apply to digital content not supplied on tangible media if:
- Performance has begun
- Consumer gave prior express consent
- Consumer acknowledged loss of withdrawal right once performance begins

Consent: By purchasing, you expressly:

Request immediate access to digital content
Consent to commencement before 14-day withdrawal
Acknowledge you lose statutory withdrawal once access is granted

11. Explicit Digital Content Commencement Consent

Purchase requires active confirmation of:
- Understanding digital content delivery
- Acknowledgment that access will begin immediately
- Waiver of 14-day withdrawal once performance begins

Consent is collected via:

Website checkbox
In-app confirmation
Platform acknowledgment mechanism

12. Subscription & Auto-Renewal Disclosure (Future Use)

Applicable for future subscription services
Subscriptions auto-renew unless cancelled
Billing cycles and prices are disclosed before purchase
Consumers may cancel via platform or written notice
Price changes will be communicated; continued use = acceptance

13. App Store & Platform Compliance

Heritage Beta may be distributed via App Store or similar
Platform providers are not parties to this agreement
Platform approval and policy changes may affect deployment
Refunds via App Store are governed by its policies; Ray Global Digital Oy has no control

Apple-Specific Addendum

Apple Inc. is a third-party beneficiary
Users confirm they are not in embargoed regions or restricted parties
Warranty claims are solely directed to Ray Global Digital Oy

14. GDPR & Child Data Protection

Ray Global Digital Oy is Data Controller.

14.1 Data Collected

Parent/Guardian: Name, Email, Payment, Communication history
Child: Name/nickname, Age range, Gameplay & learning progress, Virtual class attendance
Sensitive personal data is not collected

14.2 Lawful Basis

Contract performance
Legitimate interest
Explicit parental consent

14.3 Parental Consent

Required for all child accounts
Parents may access, correct, delete, or withdraw consent
Withdrawal may terminate Beta access if necessary

14.4 Data Usage

Anonymized data used for gameplay improvement, learning analysis, iteration
No sale or profiling for advertising
Third-party processors bound by GDPR-compliant contracts

14.5 Security

Encrypted transmission (HTTPS), access control, secure hosting
Teachers have restricted access to relevant session data
Live session links are restricted; no recording without consent
Parents may request a copy of personal data in accordance with Articles 15–22 of the General Data Protection Regulation (GDPR).

15. Limitation of Liability

Ray Global Digital Oy is not liable for indirect, consequential, or opportunity loss
Liability capped at amount paid
Finnish/EU non-excludable liability still applies

16. Intellectual Property

All content, curriculum, and game design are proprietary
Beta participants receive limited, non-exclusive, non-transferable license
No copying, distribution, or commercial exploitation
All software, source code, algorithms, educational methodologies, curriculum structures, artwork, audio, trademarks, datasets, telemetry models, AI systems, and other intellectual property remain the exclusive property of Ray Global Digital Oy unless expressly stated otherwise.

17. Modification of Terms

Terms may be updated with notice via email or platform
Continued participation = acceptance

18. Governing Law

Finnish law governs all disputes
Finnish courts have jurisdiction
These Terms shall be governed by the laws of Finland without regard to conflict-of-law principles.

19. Long-Term Vision Statement

Aspirational expansion into Swahili & other languages
Dependent on market, financial sustainability, technical feasibility
No binding guarantee of future languages

20. Entire Agreement

These Terms constitute the entire agreement between Ray Global Digital Oy and the purchaser regarding the Heritage Beta Pre-Order and supersede any prior discussions, representations, or promotional materials to the extent permitted by law.

21. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Educational Outcomes

HERITAGE is designed to support language learning and cultural engagement. Ray Global Digital Oy does not guarantee that individual learners will achieve any particular educational outcome, language proficiency level, examination result, or rate of progression.

Service Availability

During Beta, periodic maintenance, downtime and service interruptions should be expected.

That gives you breathing room if servers go offline.
